The word consumer is often defined as ‘king’ that rules the market, ‘Customer is the king’. But, if one actually wants to see the pathetic state of this so called consumer then come to India. The National Consumer Disputes Redressal Commission (NCDRC) is the apex body that sees the application of the Consumer Protection Act, 1986 at District, State and Centre level. The court is empowered by the commission to make judgment on consumer grievances that fall under the sum of Rs 20 Lakhs. The act also makes the consumer court liable to produce a verdict within 90 days of the case being registered. As part of the district fora, the consumer court provides an aggrieved consumer access to justice in a timely and affordable manner. Unlike a civil court, the consumer can start the litigation process at a consumer forum just by placing a plain written complaint. The consumer court would with-in 15 days schedule the admission hearing for the complainant to present his case. A notice is subsequently served to the opposite party seeking his reply to the complaint within 30 days of receiving the notice. In the follow through, the two parties i.e. the aggrieved consumer and the seller are given a fair chance to tell their side of the story along with all the evidences. After a comprehensive review of the case the sitting bench makes judgment and awards compensation in favor of the consumer. The court may require the erring seller to make compensation for all the financial losses or any physical injury sustained by the consumer. The compensation goes on to cover all the inconvenience / mental trauma caused to the consumer and the expenses incurred on litigation. The court may also ask the guilty to either repair or replace the defected product to make it functional for the consumer.
The consumer court Hyderabad indeed makes it possible for an average consumer to find justice in a limited time frame and at an affordable cost. The court makes sure that the consumer is able to take a valid stand on any injustice done to him by allowing him all the legal provisions on consumer rights violations. Most importantly, the court fee for this entire procedure comes to a maximum of Rs 500/- at the district forum. For all these facts, one can say that the consumer court is to a greater extent able to achieve the objectives.
