If there is a spillage in a hospital or supermarket in the UK, it is the usual policy for someone to stand by the spillage until someone else comes to dry it up and make the area safe. However, you may not expect the same standards of health and safety at hotels abroad. If you have an accident on holiday and if you think the hotel staff could have done to prevent your accident, it may be that you can make a claim against your tour operator. Contact a specialist a travel lawyer who may be able to help you – even if you are still on holiday.
Simple measures can be taken by hotel reps and hotel staff to prevent slips and trips ruining people’s holidays. Typical injuries from slipping and tripping accidents include fractured ankles and wrists, torn ligaments and on rare occasions, head injuries. By doing a simple walk through inspection by looking out for things like, leaking roofs, piping across public footpaths, ensuring steps have handrails and non-slip treads can drastically reduce the possibility of injury.
Slipping usually occurs due to the presence of a substance that should not be there such as spilt drinks or sauces or water from leaking roofs. Trip accidents usually happen because there was an object or hazard that has gone unnoticed. Given the sheer volume of hotel staff, it is easy for them to prevent people from having accident if they had your safety in mind when walking around the property. You would not leave a broom lain across your own garden path because someone might trip over it. So one questions why should hotel staff be able to get away with it?
The answer is they can’t. Why is that so? Because if your hotel has purchased as part of a package holiday you can bring an action against your UK Tour Operator under the Package Travel Regulations 1992.
It is vital if you do have an accident at a hotel, whether in this country or overseas, that you or whoever you are with gather evidence straight away. You may find that 10 minutes after your accident, the hotel may apply non-slip treads to the steps on which you fell – treads they will later claim were present prior to your accident. Make sure you take photographs of the area that you fell and report your accident to the local representative. Make sure you provide a written report and keep a copy of it.
It goes without saying that any accident must be reported to your insurance company and you should seek medical attention. Make sure you keep copies of all medical documents and insurance documents as they could be crucial to making a claim when you get back to the UK.
A UK travel law firm should be able to help you make a claim against your tour operator. The best holiday solicitors are the ones that employ people that have been litigation managers for tour operators as they will have inside knowledge of the kind of documents you need to bring a claim and the applicable local regulation.
